Mobilio Wood represented an employee of a Pennsylvania company who was injured when an industrial blender that she crawled inside of to perform a cleaning procedure was powered-on. The blender’s blades struck the employee in her head and face, causing multiple skull and neck fractures and a traumatic brain injury.
After several years of litigation and soon before trial, the employee reached a global settlement with the manufacturer of the blender, as well as with the parent company of her employer, in the amount of $2,650,000.
$2.2 Million Hostile Work Environment Settlement
Attorney Peter C. Wood, Jr. represented a group of employees at a Northeastern Pennsylvania manufacturing plant who alleged that they had been subjected to a hostile work environment, disparate treatment, and unlawful retaliation by their employer due to their race, ethnicity, and sex.
Through their counsel, the employees filed charges of discrimination with the Equal Employment Opportunity Commission (“EEOC”) and Pennsylvania Human Relations Commission, alleging violations of Title VII of the Civil Rights Act of 1964 and the Pennsylvania Human Relations Act. The EEOC investigated the matter and thereafter issued a finding of reasonable cause that unlawful employment practices had occurred.
Following the EEOC’s determination, the parties engaged in extensive negotiations. Faced with the prospect of an impending federal lawsuit, the company agreed to pay a global monetary settlement in the amount of $2,200,000.00. The company also agreed to conduct anti-harassment training for its employees and to strictly enforce its anti-harassment policies.
